MIDLAND – The Texas Supreme Court’s recent opinion of Freeport-McMoran Oil & Gas, LLC v. 1776 Energy Partners, LLC, addresses the “safe harbor” provision of the Texas Natural Resources Code with respect to an operator’s right to withhold production payments due to title disputes. Mr. Ratliff and Ms. Paulson prepared an amicus brief in the case on behalf of Texas Oil & Gas Association (“TXOGA”).
